HMRC to appeal against Livewire Telecom decision

HM Revenue and Customs (HMRC) today announced its decision to appeal to the High Court against a landmark VAT tribunal ruling. 

Earlier this month a tribunal ruled that Livewire Telecom should have £2.14m in unpaid VAT from transactions made in April 2006 returned to it. 

The hearing found that HMRC’s assertion that Livewire ‘knew or should have known’ about fraud in one of its supply chains had to be proved by HMRC. 

Martin O'Neill of Vantis, the solicitors who represented Livewire, said: 'One wonders why they are publicising that information, and if they trying to discredit the VAT tribunal's decision. If and when any appeal is made Livewire will contest it.'

No date for the appeal has been announced.
